What does “uncontested divorce” mean?
Uncontested divorce means that the spouses agree on all the terms of the divorce. It does not mean that they agree to get divorced because Florida is a no-fault state. You don’t need your spouse’s consent anyway. It means that they agree on all the terms.
Can you give me an example?
It could be, a younger couple that got married. They resided together for a short period of time. They don’t have minor children. They haven’t acquired assets or liabilities together, and they decide that it doesn’t work. They no longer want to be married. And probably they have communication issues, so they prefer to have an attorney handle all the paper work and make sure that everything is done correctly.
Another example, very common is an older couple, long term marriage. They’ve been separated for a for many years, no longer have minor children, no longer have any assets or liabilities together, but they never formalized they never made it official.
And now they want to make it official. There may be also communication issues. They want to make sure their paperwork is done by an attorney, and those are very typical examples of uncontested divorce.
