The Family Education Rights and Privacy Act (FERPA) gives parents and adult-age students rights to the privacy of the student education record. Students who attend post-secondary school, even if they are not yet 18 years of age, would be considered “adult-age”.
What exactly are education records?
Under FERPA, education records consist of “anything directly related to a student” that is maintained by an educational agency or institution, such as grades or academic standing. College representatives are not allowed to discuss information about the student’s academic records with parents.
Recent amendments to FERPA regulations specify that parents of adult age children can receive information from educational records when the health or safety of the student is threatened. But it is up to the institution to decide to disclose information in an emergency situation.
