So many times I have heard this during the first free consultation! Most parents, when facing separation or divorce, think that it would be best if they could have sole authority and ultimate decision over the children, giving the other parent merely visitation rights. And this is very easy to understand, considering how emotional the divorce can be. But the Florida Legislature had a different scenario in mind.
In Florida, most parents get what is now called “Shared Parental Responsibility”, which means that they will remain involved, consult with each other and have a saying in every important decision affecting the children’s lives, including but not limited to: health, academics and relocation. In addition, Florida is in favor of equal “Time-Sharing”, meaning that the kids will spend substantial time with both the mother and the father, in an attempt to promote a continuous and meaningful relationship with each of them.
There are exceptions to the rule, of course, when the above scenario is detrimental to the kids. This is a very high standard of proof, but it may occur when one parent has abused, neglected or somehow endangered the children.
